Just to keep you informed - I just ordered all the missing Niemann, which caprotti located in Berlin (see p.90 of alfors rarities) through my interlibrary loan service. Let's see whether the Berlin state library gives us these scores ...

... for reasons of copyright the State library in Berlin refuses to make xerocopies or to send their scores via interlibrary loan. Niemann died in 1953, so we will have to wait for 12 years to get the missing works unless alfor finds other ways to get hold of them ...

how does lending an Item through interlibrary loan qualify under copyright???

That's indeed quite strange. The Bavarian state library never had problems in sending me scores by e.g. Elliott Carter via interloan - and he is still alive...
Applying this logic stricly, a library would only be allowed to have copyright-free works in their shelves since I can't see any difference in lending a book directly in the library or via interloan. In both cases they can't prevent copying.

In case anyone wants to copy copyrighted material in the BSB, the librarian ADVISES you to order your material to the main reading hall (NOT the music reading hall).
Reason: nobody there cares for what you copy

I'm not so sure. Two years ago I was on the verge to go to Munich and stay there for 3 days for copying rare scores (Czerny et al.) after having programmed with those people a detailed list,timetable, choice of the rooms etc.
One day before I received a mail where they said that all the scores I had booked could have been copied (or better scanned) only by their staff during a period of weeks.
So I had to cancel everything ...

Sorry, I made myself not clear enough - I meant the scores under the 70 year copyright law.
Only they are allowed to copy rare scores (older than 1870) unfortunately , you are right about that.

...same in the SBB in Berlin - the first 10 pages of old stuff costs 40 € !!

For those kind of scores maybe that the self service copying machines are allowed, but remember to check before and to ask for a detailed plan about rooms (lesensaal), hours and so on, they are very precise on that points. As for Berlin library the price is not so high: I recently ordered a lot of stuff and the price for photocopies are reasonable, while the scanned scores are more expensive but not so expensive as the Munich service. The result of their scannings is wonderful, btw.
